Terms of Service

1. Eligibility & Age Requirement

You must be at least 18 years of age to create an account and use the Service. By registering, you represent and warrant that you are 18 or older and legally capable of entering into a binding agreement. Certain content tiers, including Gold/Platinum and Super Fan, contain adult-oriented material intended solely for adults. We reserve the right to verify age and identity.

2. Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You agree to provide accurate information at registration and to update it as needed. You may not share your account credentials in a manner that bypasses concurrent-stream or device limits. We may suspend or terminate accounts that violate these Terms.

3. Subscriptions & Billing

• Paid subscriptions are billed on a recurring basis (monthly or annually, depending on your plan) until cancelled.
• Payment is processed by Stripe. By subscribing, you authorize recurring charges to your selected payment method.
• Subscriptions auto-renew at the then-current rate unless you cancel before the renewal date.
• You may cancel at any time from your account settings. Cancellation takes effect at the end of the current billing period.
• All subscription payments are non-refundable. See our No-Refund Policy for details.
• Price changes, if any, will be communicated in advance with an opportunity to cancel before the change takes effect.

4. Content

The Service contains content provided by Aerixx and independent creators. Content is licensed for personal, non-commercial viewing only. You may not download, copy, redistribute, broadcast, or otherwise exploit content except as expressly permitted by the Service (e.g., offline downloads for personal viewing where available).

Creators retain ownership of their content. By uploading content, creators grant Aerixx a license to host, display, transcode, and distribute that content through the Service. Creators represent that they hold all necessary rights to their uploaded content and that it complies with these Terms and applicable law.

5. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms.
• Upload, post, or share content that is illegal, infringing, harassing, or that you do not have rights to.
• Upload content depicting anyone under 18, or content that sexualizes minors in any way.
• Attempt to access content you have not paid for or circumvent access controls.
• Interfere with the Service's operation, including introducing malware or scraping content.
• Harass, threaten, or impersonate other users or creators.

6. Creator Monetization

Creators who participate in monetization features (subscriptions, tips, pay-per-view, merchandise) do so under the revenue-share terms presented in the Creator Studio. Aerixx is not a party to disputes between creators and their subscribers, but may intervene to enforce these Terms. Payouts are processed through Stripe Connect and subject to Stripe's terms and verification.

7. Intellectual Property

The Service, including its branding, design, and original content, is owned by Aerixx and protected by intellectual property laws. These Terms do not grant you any right to use Aerixx trademarks, logos, or branding.

8. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind. We do not guarantee that the Service will be uninterrupted, error-free, or secure. To the fullest extent permitted by law, we disclaim all implied warranties.

9. Limitation of Liability

To the maximum extent permitted by law, Aerixx shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits or data, arising from your use of the Service. Our total liability for any claim is limited to the amount you paid us in the 12 months preceding the claim.

10. Termination

You may close your account at any time. We may suspend or terminate your access to the Service if you violate these Terms or for any other reason at our discretion. Upon termination, your right to use the Service ends, but these Terms remain in effect for matters relating to prior use.

11. Governing Law & Disputes

These Terms are governed by the laws of the jurisdiction in which Aerixx operates, without regard to conflict-of-law principles. Any disputes will be resolved through binding arbitration where permitted, and you waive any right to participate in a class action.

12. Changes to These Terms

We may update these Terms from time to time. We will post the revised Terms and update the "Last updated" date. Continued use of the Service after changes constitutes acceptance of the revised Terms.
